Where a sentencing judge fails to refer to a guilty plea or discount in the reasons for sentence, the error is material if there is a real possibility the plea was not properly considered, but immaterial if the appellate court can be affirmatively satisfied the discount was applied. The unresolvable uncertainty as to whether the discount was applied is itself sufficient to demonstrate error. The Crown cannot succeed on a basis that denies an error of law.
