A sentence of a s 9 bond for an offence of perverting the course of justice where the offender was an active and enthusiastic participant in creating a false alibi is manifestly inadequate. However, the residual discretion may be exercised to dismiss a Crown appeal where resentencing to imprisonment would seriously jeopardise the offender's ongoing rehabilitation from drug addiction and treatment for mental health conditions. The sentences imposed for perverting the course of justice offences have not properly matched the seriousness the Court has repeatedly expressed concerning such offences.
