A sentencing judge is not bound to accept the opinion of any one psychiatric expert and is entitled to prefer more cautious assessments when reconciling conflicting psychiatric evidence. A finding that the diminution of moral responsibility due to mental health conditions is 'slight' is open where there is no contemporaneous evidence of psychotic symptoms at the time of the offence.
