In dangerous driving cases, the offender's speed may be treated as an aggravating factor even where it is below the speed limit, if it is excessive in light of the surrounding circumstances. Where inattention is found to be sustained rather than momentary, the distance over which the driver was inattentive is a relevant aggravating factor. Commission of a result offence (not just an intentional offence) while on conditional liberty for an unrelated offence can constitute an aggravating circumstance.
