A forensic decision not to lead evidence of assistance to police at sentencing will not ordinarily ground a miscarriage of justice on appeal, particularly where the evidence was available and the applicant offers no reasonable explanation for the omission. Evidence of assistance that generated only one intelligence report containing largely already-known information, did not lead to any investigation or arrests, and was unverifiable, is of such little value that it would not affect the sentencing outcome.
