Sections 91D(1)(a) and 91F of the Crimes Act 1900 (NSW) create distinct offences with different elements: s 91D requires proof of causation of the child's participation in prostitution, while s 91F requires proof of capacity to exercise lawful control over premises where child prostitution occurred. A person may be convicted of both offences arising from overlapping facts without duplicity or double jeopardy, but the overlap must be addressed in sentencing through the totality principle.
