A juror who tells a close family member or health professional that they are feeling physically or mentally unwell due to the pressures of jury service does not contravene s 50 of the Jury Act 1995 (Qld) or breach their oath. Section 54(1) restricting communication with jurors applies only while the jury is kept together and has no application after the jury has been allowed to separate under s 53(7). When a juror is discharged and the jury has been unable to reach a unanimous verdict, the trial may continue with the remaining jurors under s 57 unless there is evidence (not mere speculation) that the discharged juror was a dissenting juror.
