The 'public interest' discretion in s 93ZZB(2) of the Criminal Proceeds Confiscation Act 2002 (Qld) to refuse to make a serious drug offender confiscation order is not confined to the objects of the Act in s 4 but extends to consideration of the personal circumstances of the offender, including age, health and financial circumstances. A construction that confines the discretion to the statutory objects would render it redundant. The public interest discretion in s 93ZZB(2) and s 93ZZF(2) is the sole means by which a prescribed respondent can seek exclusion of lawfully acquired property unconnected with criminal activity from confiscation under Chapter 2A.
