A sentencing judge's mischaracterisation of the objective seriousness of offending conduct constitutes an error warranting appellate intervention. For youthful offenders (here, 19 years old) with no criminal history, good rehabilitation prospects, a timely guilty plea, and remorse, actual imprisonment for dangerous operation of a vehicle causing grievous bodily harm may not be warranted where the driving, though foolish and dangerous, does not amount to driving 'of an extreme kind'.
