When exercising the discretion under s 12 of the Penalties and Sentences Act 1992 (Qld) whether to record a conviction, a sentencing judge may properly consider whether the non-recording of a conviction would inappropriately conceal the court's opinion as to the serious nature of the offending from regulatory authorities, even where the underlying offending conduct would come to the authority's attention in any event. The supply of a Schedule 1 drug remains an inherently serious offence warranting the recording of a conviction even where the offending is at the very low end of the spectrum.
