The relevant risk-creating conduct for the purposes of assessing breach of duty must be precisely identified: the risk here was not from using a knife to peel an orange, but from rising from a crouched position with an unsheathed sharp blade in an area traversed by workers. Misidentification of the risk led to an erroneous conclusion on breach. On quantum, a trial judge's adoption of actual post-injury earnings as the measure of hypothetical but-for earnings may be inadequate where it fails to account for the possibility that the plaintiff would have continued in higher-paying full-time employment for a substantial period.
