A conviction entered on a plea of guilty and agreed statement of facts is not vitiated by discrepancies between the agreed facts and the prosecution's witness statements, where the applicant does not testify to innocence or explain the guilty plea. Sentences of eight years with a serious violent offence declaration for armed robbery and wounding with intent in the course of a violent home invasion involving machetes are within the permissible range.
