Section 18A of the Criminal Law (Sentencing) Act 1988 (SA) may be used to impose a single sentence for multiple offences where one is a serious and organised crime offence and another is not, and the test for suspension of such a combined sentence is the 'exceptional circumstances' test under s 38(2ba). The determination of whether exceptional circumstances exist is governed by the principles of appellate restraint in House v The King. Financial consequences of offending such as pecuniary penalties under the Criminal Assets Confiscation Act and loss of employment or business opportunities do not, without more, constitute exceptional circumstances.
