Section 50 of the Criminal Law Consolidation Act 1935 (SA) does not require each act of sexual exploitation to be identified by distinguishing circumstances peculiar to each occasion; it requires only proof of two or more prescribed sexual offences over a period of three or more days. The decision in R v Johnson, which set aside a conviction for insufficient particularity, is confined to the factual question of whether a verdict was unreasonable and does not establish a legal requirement of specificity as an element of the offence or as a prerequisite for a case to answer. Section 352(1)(ab) as re-enacted in 2008 applies to all proceedings commenced after 3 August 2008 regardless of when the offence was committed.
