A sentencing judge who rejects one aspect of a forensic psychologist's report (such as the finding of remorse) is not entitled to dismiss the entire report; the remaining opinions on criminogenic factors, prognosis, and the exclusion of sexual dysfunction must still be given weight. Sentences as high as 14 years for rape have not been imposed in South Australia unless a weapon was used or the offending involved protracted violence over and above the sexual violence of the rape itself.
