Section 20AAC(1)(d) of the Criminal Law (Sentencing) Act 1988 (SA) does not preclude the use of s 18A to impose a single penalty for multiple serious firearm offences; it only precludes using s 18A to combine serious firearm offences with non-serious firearm offences in a single penalty. When sentencing for both categories, the sentencing judge must impose a separate sentence (or s 18A single penalty) for the serious firearm offences and a separate sentence (or s 18A single penalty) for the non-serious firearm offences. Conflating individual sentencing with the s 18A approach by applying global concurrency and time-served allowances without articulating their effect on individual sentences will cause the sentencing exercise to miscarry.
