Where a sentencing judge imposes a single composite sentence under s 18A of the Criminal Law (Sentencing) Act 1988 (SA) across multiple offences, the successful appeal against conviction on any of those offences necessarily requires the entire single sentence to be set aside, not merely the component referable to the quashed convictions. Section 354(1) of the CLCA does not empower the Court of Criminal Appeal to set aside sentences on convictions not the subject of the appeal and remit them for re-sentencing. The Court identified this as a gap warranting legislative attention.
