The 'good cause shown to the contrary' proviso in s 60 of the Supreme Court Act 1986 (Vic) cannot be used to extend the period of interest beyond the commencement of the proceeding; it operates only to reduce or deny interest in favour of the defendant. A party serving a Calderbank offer or offer of compromise in defamation proceedings who also wishes to rely on s 40 of the Defamation Act 2005 for indemnity costs from the commencement of the proceeding should expressly refer to s 40 in the offer, or risk the 'interests of justice' exception being engaged.
