Section 27 of the Road Safety Act 1986 (Vic) confers a broad discretion on VicRoads to require any relevant person to undergo driving tests without needing to establish any jurisdictional fact such as physical or mental unfitness. 'Unfit to drive' in s 27 encompasses lack of competence and lack of awareness of road laws, read in light of the licensing purposes in s 17. A factual error by VicRoads in the course of exercising this broad discretion (such as an incorrect belief about a person's licence history) is an error within jurisdiction, not a jurisdictional error amenable to certiorari.
