Where applications for leave to appeal are dismissed because the subject matter has been overtaken by an arbitration award, and both parties acted reasonably, the court will make no order as to costs applying the Lai Qin principles. The potential for an arbitration award to overtake interim statutory entitlements does not render it unreasonable for a party to pursue an appeal from orders affecting those interim entitlements.
