Section 16A(2)(g) of the Crimes Act 1914 (Cth) requires sentencing courts to take into account the objective utilitarian benefit of a plea of guilty for Commonwealth offences. The Tyler line of authority, which denied such a discount on the basis that Cameron v The Queen altered the common law position, is plainly unsustainable and should not be followed. The principle of comity does not require one intermediate appellate court to follow another's interpretation of High Court reasons where that interpretation is considered plainly wrong.
