Practitioners prosecuting or defending importation charges under s 307.1 of the Criminal Code (Cth) should note that the Kural inferential reasoning (awareness of likelihood) cannot simply be transposed to the element of intention to import 'a substance' without careful adaptation, and that jury directions must make clear that awareness of likelihood is merely a permissible path of reasoning, not the equivalent of establishing intention.
