A hope or belief that victims of a Ponzi scheme would ultimately be repaid is no answer to charges of obtaining property or financial advantage by deception where the funds were in fact used for purposes other than those represented. Depression and psychological unsophistication, without cognitive impairment, are insufficient to establish that an accused was overborne into pleading guilty or did not appreciate the nature of the plea.
