There is no requirement to apply a blanket 25 per cent (or any other fixed) discount to compensation orders under s 85B of the Sentencing Act 1991 (Vic). RK v Mirik and Mirik is authority only for the proposition that a court may, in appropriate circumstances, reduce compensation to guard against overshooting, but whether and to what extent any reduction is warranted must be determined on the facts of each case. A compensation order leaving an offender with approximately $300,000 in assets after payment of approximately $376,000 in compensation for sustained child sexual abuse of four victims is not excessive.
