Receipt of a document over the counter by a clerk in the Court of Appeal office does not constitute 'filing' for the purposes of r 10(1) of the Court of Appeal Rules; the registrar retains power to refuse to accept the document for filing if it does not comply with the rules or court orders. There is no right to be heard before such refusal, the exclusive remedy being the de novo review process under rr 15-16. The Court of Appeal constituted by two or more judges has jurisdiction to hear such review applications.
