The post-transitional sentencing range for unlawfully doing grievous bodily harm under s 297(1) of the Criminal Code (WA) is between 8 months and 5 years 4 months, with offences towards the upper end of the range attracting sentences of 3 to 5 years. Sentences of 3 years 3 months for a group attack with weapons on a defenceless victim, resulting in a finger tendon injury, fall within the range open to the sentencing judge. Cumulative sentences are appropriate where counts are separate and distinct offences with a material interval between their commission.
