A court will refuse to stay a well-advanced appeal pending resolution of newly commenced proceedings in another court where those new proceedings are in their infancy, the applicant has delayed seeking the stay, and there is no evidence that the new proceedings have reasonable prospects of rendering the appeal otiose. Self-represented litigants who are well-versed in litigation and who bring meritless applications based on unsubstantiated fraud allegations may be ordered to pay indemnity costs.
