An order striking out a notice of appeal and the appeal on the ground of abuse of process is an interlocutory order, not a final order, and leave to appeal is required. This applies even where proceedings are dismissed as frivolous, vexatious, or an abuse of process. A costs order associated with an interlocutory order is itself interlocutory. The question whether an appellate order is necessarily interlocutory where the underlying first instance decision was interlocutory was left open.
