The Residential Tenancies Act 1997 (ACT) does not apply to leases granted by the Wreck Bay Aboriginal Community Council on Aboriginal Land insofar as ss 8 and 9 of the RT Act would impose mandatory standard residential tenancy terms or void inconsistent terms. ACT laws applied in the Jervis Bay Territory by s 4A of the Acceptance Act retain their subordinate character vis-à-vis Commonwealth Acts and do not take effect as Commonwealth legislation. The interest vested in the Council under the LG Act is a statutory title, not an estate in fee simple, and the Council's power to grant leases under s 38(2) includes the power to determine the terms of those leases.
