A vague reference in a statement of claim to Twitter links to an ABC Radio site does not constitute a pleading of a cause of action based on the content of an ABC Radio interview, and accordingly the interview-based cause of action does not arise from the same or substantially the same facts for the purposes of s 65(2)(c) of the Civil Procedure Act 2005 (NSW). An implicit invitation to 'click the links' is wholly ineffective as a means of pleading a defamation claim in respect of whatever might be seen if the links were clicked.
