Where executors have given undertakings not to make further distributions from an estate pending appeal, and estate properties have been sold or are under binding contracts for sale, the balance of convenience will not favour a stay of a probate order. Applications for accounting by executors must be made in the probate proceedings under Supreme Court Rules 1970, Pt 78, rr 75 and 89, not in appeal proceedings.
