A stay of proceedings pending appeal will be refused where none of the grounds of appeal are reasonably arguable and the balance of convenience favours the successful party, particularly where the successful party has been kept out of the fruits of judgment for a prolonged period and has proffered an undertaking to preserve the subject property.
