The Burgundy Royale test for a stay pending special leave to appeal to the High Court will not be met where no grounds of appeal have been formulated, no evidence of prejudice has been led, and counsel does not yet have instructions to seek special leave. However, a court may make a short-term mechanical order to preserve the opportunity for a properly supported stay application where the decision under appeal was handed down the same day.
