Leave to appeal from interlocutory orders refusing amendment of pleadings requires more than identification of arguable error; the applicant must demonstrate issues of principle, questions of public importance, or that injustice has reasonably clearly occurred. A claim that a business owes a direct duty of care for the criminal acts of an employee or independent contractor based on knowledge of criminal tendencies requires identification and pleading of the novel duty of care with precision, and the relevant Stavar factors must be addressed. Damages for humiliation and hurt to feelings may arguably be recoverable for trespass to goods, extending the reasoning in Anning beyond trespass to land.
