A conviction entered on a guilty plea will not be set aside on appeal unless the applicant demonstrates a miscarriage of justice, which requires showing a real question about the guilt of the accused. Bare allegations of evidence destruction or entrapment, unsupported by evidence, are insufficient to impugn the integrity of a guilty plea. There is no substantive defence of entrapment under Australian common law.
