A security guard at licensed premises is 'vulnerable' for the purposes of s 21A(2)(l) of the Crimes (Sentencing Procedure) Act 1999 (NSW), notwithstanding that security guards may be physically strong or trained in self-defence. The vulnerability arises from the nature of the occupation, which requires the worker to encounter and control intoxicated and disorderly individuals, often in isolation from others who may assist. The statutory duties imposed on licensees by ss 73, 74 and 77 of the Liquor Act 2007 (NSW) reinforce this finding.
