In prosecutions for development without consent within a heritage conservation area under a local environmental plan, it is not necessary to independently prove that the area is of heritage significance. The designation of an area as a heritage conservation area in the schedule and heritage map of the LEP is sufficient. The phrase 'an area of land of heritage significance' in the definition of 'heritage conservation area' operates as a description, not as an independent element of the offence.
