The Bugmy principle concerning reduced moral culpability from childhood deprivation does not apply to planned and organised drug supply offences where the offending does not involve impulsive wrongdoing. The differentiation in subjective circumstances between co-offenders should be reflected in part in the length of overall sentences, not solely in the non-parole period ratio. A sentencing judge is justified in giving no weight to s 21A(3)(a) where drugs are seized in a police-controlled operation.
