A sentence of a 2-year ICO for recklessly causing grievous bodily harm in a glassing incident causing near-total loss of sight in one eye was manifestly inadequate, even where the use of the glass was not deliberate. However, the residual discretion may be exercised to decline to interfere where the offender's mental health has significantly deteriorated since sentencing, there is an increased risk of self-harm, and the offender has complied with ICO conditions and is progressing towards rehabilitation.
