Gambling addiction, even when causative of fraud offending, is generally not a mitigating factor on sentence, though steps taken to address the addiction may be relevant to prospects of rehabilitation. A sentencing judge is not required to apply a specific numerical discount for partial repayment of stolen monies; doing so would constitute an erroneous two-stage approach to sentencing.
