The order in which a sentencing judge announces the aggregate sentence and indicative sentences does not of itself establish a contravention of s 53A(1)(b) of the Crimes (Sentencing Procedure) Act 1999, provided the remarks as a whole do not lead to the irresistible conclusion that the discount was applied to the aggregate rather than the indicative sentences. The absence of prior convictions does not necessarily attract a more lenient sentence for offences such as drug supply, where good character may facilitate the commission of the offence.
