The Court refused interlocutory injunctive relief to a respondent seeking to restrain enforcement of an adjudication determination under the SOP Act where the respondent delayed seeking relief, failed to seek undertakings from the claimant not to enforce, and the garnishee order had already been satisfied. McDougall J held that even accepting a serious question to be tried as to the determination's validity, the application failed on discretionary grounds due to delay and the absence of evidence that the claimant would be unable to repay the adjudicated amount if the challenge succeeded. The Court also held that an applicant for a garnishee order is not necessarily required to disclose the existence of separate proceedings challenging the underlying adjudication determination, though left open that bad faith in procuring a garnishee order could warrant setting it aside.
