Section 19 of the Personal Injuries (Liabilities and Damages) Act 2003 (NT) does not preclude aggravated or exemplary damages where the harm suffered from an intentional tort is distress and humiliation rather than personal injury, because the section prohibits such damages only 'in respect of a personal injury', not in an action for personal injuries generally. The exemption for prison officers under s 12(2) of the Weapons Control Act 2001 (NT) extends to prison officers called to assist at a youth detention centre. Prison officers called to assist at a youth detention centre are persons 'lawfully called upon to assist' within s 157(2) of the Youth Justice Act 2005 (NT). The use of restraints (spit hoods, shackles) on compliant youth detainees who have not been individually assessed as presenting a specific risk is not reasonable and necessary, even where some detainees in the group have a history of violence.
