In appeals by way of rehearing under s 222 of the Justices Act 1886 (Qld), the appellate court must conduct a real review of the evidence and decide the case for itself; there is no onus on the appellant to demonstrate error, and the House v The King discretionary appeal standard has no application. A failure to give adequate reasons in such an appeal is itself a sufficient ground for allowing a further appeal.
