The power to strike out an appeal for non-compliance with procedural rules must be exercised with the utmost caution, and an appeal will not be struck out where there are arguable errors in the primary judge's reasoning, even if the appeal is improperly constituted and fails to state grounds. On summary judgment applications, the fact that a self-represented litigant's defence is poorly pleaded should not be weighed too heavily; the relevant question is whether, properly pleaded, there is a viable defence.
