A deliberate decision not to commence a family provision application within the limitation period, made on the advice of solicitors and counsel and evidenced by contemporary correspondence, is a matter that may weigh heavily against an extension of time under s 41(8) of the Succession Act 1981 (Qld). Where the applicant's share of the estate is more than adequate for proper maintenance and support, the absence of reasonable prospects of obtaining further provision supports refusal of an extension.
