A new expert report obtained after a guilty plea, which merely offers an alternative opinion on the significance of an already-known fact rather than revealing a new fact, does not establish a foundation for setting aside the plea. Where a sentencing judge imposes a driver's licence disqualification, the judge must give consideration to and provide reasons for the factors identified in R v Osborne, including consequences for employment, risk of disincentive to rehabilitation, and whether the disqualification gives rise to an unjust overall punishment. A disqualification period that lacks proper purpose beyond what is served by the head sentence and operational period is manifestly excessive.
