A head sentence of five years' imprisonment with approximately 20 months in actual custody for trafficking in methylamphetamine and MDMA over 13 months, combined with nine importation offences via the online black market, is not manifestly excessive even where the offender is young, has pleaded guilty, shown remorse, and demonstrated impressive rehabilitation on bail. Practitioners must ensure the correct maximum penalty is identified for each count, particularly distinguishing between s 307.3 and s 307.4(1) of the Criminal Code (Cth) which carry maximum penalties of 10 years and 2 years respectively.
