A party whose application to adduce further evidence is refused during a part-heard freezing order application is not irremediably prejudiced by the hearing continuing, because the evidentiary ruling can be challenged on appeal from any freezing orders ultimately made. An argument for recusal cannot be raised on appeal where no decision on recusal has been made by the primary judge.
