The Children's Court of Queensland is a separate specialist court established under the Children's Court Act 1992, not part of the District Court or Supreme Court. The Child Protection Act 1999 confers exclusive jurisdiction on the Children's Court for child protection orders, limiting the otherwise unlimited jurisdiction of the Supreme Court. Proceedings in the Children's Court cannot be cross-vested to the Federal Circuit Court or Family Court under the Jurisdiction of Courts (Cross-vesting) Act 1987 unless the requirements of s 8 are met, and no appeal lies from a refusal to transfer or remove proceedings under s 13 of that Act.
